Terms of Service
1. Acceptance of Terms
By creating an account, accessing, or using the Bloom mobile application ("Service"), you agree to be bound by these Terms of Service. The Service is licensed, not sold, to you. If you do not agree, you must not use the Service.
Bloom is a tool designed for couples to share memories. Account creation and subscription management is strictly limited to individuals 18 years of age or older.
2. Eligibility & Account Responsibilities
- Adult Use Only: Accounts may only be created by legal adults (18+).
- Account Security: You are responsible for safeguarding your login credentials. You are responsible for all activity that occurs under your account.
3. User Conduct & Content Policy
Bloom is a private space for partners. We have a Zero Tolerance Policy for misuse:
- Prohibited Content: You agree not to upload content that is hateful, harassing, distribution of illegal material, or generally abusive.
- Respect for Privacy: You must respect the privacy and consent of your partner when sharing memories, location, or communication within the app.
- No Unauthorized Access: You may not attempt to gain unauthorized access to the Service, its servers, or any connected systems. Hacking, password mining, or circumventing any security measure is strictly prohibited.
- No Automated Scraping: Use of bots, scripts, crawlers, or other automated tools to extract data from the Service is prohibited. All access must be through the app's intended interface.
- No Impersonation or Fraud: You may not impersonate any person or entity, or misrepresent your identity or affiliation when using the Service.
- Reporting: If you encounter inappropriate behavior or a breach of these terms, please contact us immediately.
4. Subscriptions & Payments
- Payment Processing: All payments are processed securely by Apple (App Store) or Google (Play Store) via RevenueCat. Bloom never collects or stores your credit card, bank account, or full payment details.
- Restoring Purchases: If you switch devices or reinstall the app, you can restore your active subscription by using the "Restore Purchase" functionality in the app settings, using the same respective Apple/Google account.
- Refund Policy: All refund requests must be processed directly by Apple or Google. Bloom does not have the ability to process refunds or cancel subscriptions on your behalf.
- Renewals: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period in your device's subscription settings.
- Cancellation: You may cancel at any time through your App Store or Play Store account settings. Upon cancellation, you retain access to premium features for the remainder of the current billing period. No partial refund is issued for the unused portion.
5. Intellectual Property
- Your Inputs: You retain full ownership of the photos, audio notes, text, and other memories you provide and upload to Bloom.
- Service Limits: You are responsible for ensuring that the content you upload does not violate existing copyrights or trademarks of third parties.
6. AI-Powered Features & Generated Content
Bloom includes optional AI-powered features, including relationship chat ("Pookie AI"), personalized song generation, and relationship insights, powered by third-party providers including Google Gemini and Minimax.
- No Professional Advice: AI-generated content, including songs, chat responses, and relationship insights, is provided for entertainment and personal enjoyment only. It does not constitute professional, medical, psychological, or relationship advice.
- No Guarantee of Accuracy: We make no warranty regarding the accuracy, appropriateness, or quality of any AI-generated output. Use such content at your own discretion.
- Ownership of AI Output: AI-generated content (songs, responses) produced using your inputs is licensed to you for personal, non-commercial use only. You may not commercially exploit or redistribute AI-generated outputs.
- Opting Out: You can disable the sharing of data with AI providers at any time in your app settings.
7. Service Limitations & Downtime
We are committed to providing a reliable experience, but there may be instances where access to the Platform is limited or unavailable. We periodically perform maintenance and updates, which may result in temporary service disruptions. Furthermore, unexpected technical issues, network disruptions, or external events beyond our control (Force Majeure) may cause downtime.
The Platform is provided on an "as-is" and "as-available" basis. We disclaim liability for any interruptions, and service interruptions do not entitle users to refunds or credits.
8. Account Inactivity & Data Deletion
To ensure optimal system performance and manage server resources, accounts that remain inactive for a continuous period of 12 months may be subject to deactivation. Inactivity is defined as the absence of any login or interaction with the Platform.
For users on a free plan, if an account remains inactive for 12 months, we reserve the right to permanently delete all associated user-generated content (photos, videos, memories). Once deleted, this data cannot be recovered.
9. Third-Party Links
Bloom may contain links to external websites and resources provided by third parties. These links are provided for your convenience. We do not govern or endorse these third-party sites, and we are not liable for any damage or loss caused by your use of them.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLOOM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED FIFTY US DOLLARS ($50).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitation or exclusion may not apply to you.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED.
12. Indemnification
You agree to indemnify, defend, and hold harmless Bloom from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:
- Your use of and access to the Service;
- Your violation of any term of these Terms of Service;
- Your violation of any third-party right, including without limitation any copyright, property, or privacy right;
- Any claim that content you uploaded or shared caused damage to a third party.
This indemnification obligation will survive these Terms of Service and your use of the Service.
13. Apple App Store & Google Play Terms
If you downloaded Bloom from the Apple App Store or Google Play Store, you acknowledge and agree that:
- This Agreement is between you and Bloom, not Apple or Google. Apple and Google are not responsible for the App or its content.
- Apple and Google have no obligation whatsoever to furnish any maintenance and support services with respect to the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple or Google, and they will refund the purchase price to you. To the maximum extent permitted by applicable law, Apple and Google will have no other warranty obligation with respect to the App.
- Bloom, not Apple or Google, is responsible for addressing your claims relating to the App, including product liability claims and claims that the App fails to conform to any applicable legal or regulatory requirement.
- In the event of any third-party claim that the App infringes that third party's intellectual property rights, Bloom, not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- You must comply with applicable third-party terms of agreement when using the App (e.g., your wireless data service agreement).
- Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance, Apple will have the right to enforce this Agreement against you.
14. Software Restrictions & Technical Data
- License Scope: We grant you a personal, non-transferable license to use the Bloom app on compatible devices that you own or control, as permitted by the App Store and Play Store Terms of Service.
- Restrictions: You may not copy, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Bloom app or any part thereof.
- Technical Data: You agree that we may collect and use technical data — including information about your device, system, and application software — gathered periodically to provide software updates, product support, and service improvements. This data is collected in a form that does not personally identify you.
15. Export Compliance
You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
16. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the date at the top of this page and, where appropriate, providing notice within the app. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
17. Dispute Resolution & General Provisions
These Terms shall be governed by and construed in accordance with the laws of Gujarat, India. You irrevocably consent that the courts of Gujarat, India shall have exclusive jurisdiction to resolve any dispute arising in connection with these Terms.
- Class Action Waiver: You agree that any dispute will be resolved on an individual basis only. You expressly waive your right to bring or participate in any class, collective, or representative action against Bloom.
- Force Majeure: We shall not be liable for any failure to perform our obligations where such failure results from causes beyond our reasonable control, including mechanical or electronic failure, acts of God, war, terrorism, civil unrest, or governmental action.
- Assignment: These Terms are personal to you and are not assignable or transferable by you without our prior written consent. We may assign or transfer our rights and obligations without consent.
- Waiver: Our failure to enforce any part of these Terms shall not constitute a waiver of our right to later enforce that or any other part of these Terms.
- Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bloom regarding the Service, and supersede all prior agreements or understandings, whether written or oral, relating to the same subject matter.
